Agreement to Terms
Welcome to FirstCall Encinitas Towing. By using our towing and roadside assistance services, you agree to these Terms of Service. Please read them carefully before requesting our services. If you do not agree with these terms, please do not use our services.
Services We Provide
We provide professional towing and roadside assistance services in Encinitas, CA and surrounding areas. Our services include emergency towing, flatbed towing, roadside assistance, and related vehicle recovery services.
Service availability is subject to factors including weather conditions, equipment availability, and operator schedules. We make every effort to respond promptly to all service requests.
Payment and Pricing
Payment is due at the time services are rendered unless other arrangements have been made in advance. We accept cash, credit cards, and debit cards. Prices are based on the type of service, distance traveled, time of day, and vehicle specifications.
Price estimates provided over the phone are approximate and may change based on actual conditions encountered during service. Additional charges may apply for specialized equipment, difficult recoveries, or after-hours service.
Your Responsibilities
When you request our services, you are responsible for providing accurate information about your vehicle location, condition, and any special circumstances. You must be present or designate an authorized representative to be present when services are performed.
You are responsible for removing all personal belongings from your vehicle before towing. FirstCall Encinitas Towing is not responsible for items left in vehicles during transport.
You must have proper authorization to request towing services for the vehicle in question. This includes being the owner, having written permission from the owner, or being an authorized representative of the owner.
Liability and Insurance
FirstCall Encinitas Towing maintains proper insurance coverage as required by California law. We take great care in handling your vehicle and use industry-standard equipment and procedures.
We are not liable for pre-existing damage to your vehicle or damage that occurs due to the inherent condition of the vehicle. Our liability is limited to damage directly caused by our negligence during the towing process.
Claims for damage must be reported within 24 hours of service completion. You must provide photographic evidence and a detailed description of the claimed damage.
Cancellations and Refunds
If you need to cancel a service request, please contact us as soon as possible. Cancellations made before our operator arrives at your location will not incur charges.
If our operator has already been dispatched and is en route to your location, a service call fee may apply. Once our operator arrives at your location, the full service fee is due even if you decide to cancel.
Storage and Impound
If your vehicle is towed to our storage facility, daily storage fees will apply beginning 24 hours after the vehicle arrives. Storage fees continue to accrue until the vehicle is retrieved.
To retrieve your vehicle from storage, you must provide proper identification, proof of ownership or authorization, and payment for all outstanding towing and storage charges.
Limitation of Liability
To the maximum extent permitted by law, FirstCall Encinitas Towing will not be liable for any indirect, incidental, special, or consequential damages arising from our services. Our total liability for any claim will not exceed the amount paid for the specific service in question.
Changes to Terms
We may update these Terms of Service from time to time. Changes will be posted on this page with an updated revision date. Your continued use of our services after changes are posted constitutes acceptance of the new terms.
